Shawano man gets 15 years for child porn

A Shawano man who previously pleaded guilty to production of child pornography was sentenced Jan. 19 in federal court to 15 years in prison.

According to court documents, Brandon Boogren, 29, used a cellphone on May 16, 2019, in Shawano to record several videos of a 2-year-old girl engaged in a sex act. Boogren can be heard on the video cajoling the girl to engage in the act.

Boogren had an online relationship with a man in Houston, Texas, who represented himself as a woman. The man asked Boogren to send him pictures of himself. Their online chats suggested that Boogren was drinking heavily and abusing Xanax. The Houston man then asked Boogren for videos and Boogren sent him four sexually explicit recordings of a child.

Six years later the FBI investigated the Houston man and found the videos, Boogren’s phone number and referred the matter to the FBI in Wisconsin.

Last June, Boogren was questioned by FBI agents and Shawano police and admitted to creating the images and sending them to the Houston man.

Boogren’s attorney, Thomas Phillip, wrote the court that his client recognizes that his drug and alcohol use caused his legal problems and to lose jobs. He has remained sober since being indicted last June.

While on release prior to pleading guilty, Boogren completed community service hours ordered in a misdemeanor conviction for disorderly conduct.

Boogren ran his own construction and remodeling business for the past two years, being the breadwinner for his girlfriend of 13 years and their three children.

Phillip contended that a 15-year sentence was just punishment for the serious offense Boogren committed. The crime occurred six years ago, and Boogren told the FBI he hasn’t repeated the offense when questioned during a polygraph test, which indicated no deception in Boogren’s answer.

“Fifteen years is a very significant penalty for Boogren, or for anyone. A longer term is not necessary to fulfill any of the policy objectives of the sentencing,” Phillip wrote.

At the sentencing, federal Judge William Griesbach called Boogren’s crime “horrendous” and “extremely serious.”

He further stated that Boogren’s criminal acts called for strong punishment.

After his 15-year prison sentence, Boogren will serve five years on supervised release and be placed on the state and U.S. sex offender registries.
